New legislation: tighter data controls
Despite the fact that Britain is set to leave the EU, the Government has decided to adopt the General Data Privacy Regulation (EU) 2016/679 (GDPR) which is due to come into force in May of 2018. This new legislation will require most businesses to significantly change the way they handle and store data. The regulation spans more than 200 pages and will replace the Data Protection Act 1998. Its goal is to strengthen security and privacy protection.
Most businesses will already have some sort of backup systems in place but these are highly unlikely to meet the new stringent requirements of the GDPR. In the event of a data breach, businesses will need to demonstrate that appropriate security controls were in place – and most will fail.
The new GDPR increases penalties for breaches from an already severe £500,000 to a staggering €20 million or 4% or annual global turnover – whichever is higher. Businesses have just a few months to ensure they fully comply with the changes, with secure storage of data being just one of many aspects to consider.
